For the purposes of this License Agreement, the aforementioned program is referred to as Alaguide.
Before using the program and the system, please read the terms of this License Agreement. Any use of the program by you means that you fully and unconditionally accept the terms of this License Agreement.
If you do not accept the terms of this License Agreement in full, you will not be entitled to use the Program for any purposes.
1. License
1.1. This License Agreement («License») has been made between you, as the user («User») and Emakho, L.L.C, the owner of exclusive rights to the Alaguide Program («Right Holder»), hereinafter the Program.
1.2. The License establishes the terms of use of the Program by the User for a Mobile Phone, Communicator or Computer and any other device, including a mobile device («Device») on which the Program is able to operate.
1.3. By copying the Program and installing it on your Device, the User fully and unconditionally agrees with all the terms of this License.
1.4. Use of the Program is permitted only on the terms of thisLicense. If the User does not accept the terms of this License Agreement in full, the User will not be entitled to use the Program for any purposes. Use of the Program in breach of (non-compliance with) any of the License terms isprohibited.
1.5. Use of the Program on the terms of this License is free for Users receiving information through the Right Holder’s website (Alaguide.io)and through a mobile device.
2. Rights to the Program
2.1. Exclusive copyright for use of the Program belongs to the Right Holder.
3. Program User rights
3.1. The Right Holder grants the User non-exclusive, non-transferable right to use the Program in the following ways:
3.1.1 To use the Program for its designated purpose by copying and installing it on the User’s Device. The User may install the program on an unlimited number of Devices.
3.1.2. The program shall be used under the brand name «Alaguide».The User may not change the brand name of the Program, change and/or delete the description of the Right Holder’s copyright.
4. Rules for working with the app, posting materials and comments
4.1. The main language of the app is Russian and English, and preparing materials and comments in these languages isrecommended.
4.2. The following are strictly prohibited within the app: swearing, abusive language, harassment, and humiliating or slandering members of the community or other persons. The User will receive a warning for a specific breach, and may be temporarily or permanently blocked by the owner or moderators.
4.3. Comments and notes shall not be subject to moderation before posting.
4.4. Posting advertising materials and comments unrelated to the website topic, spam and irrelevant topics isprohibited.
4.5. The User shall mark all content he/she posts coming under the «18+» symbol: information promoting drugs, alcohol, tobacco, prostitution, life-threatening actions, suicide, questioning family values, and respect for parents. Uncensored information and pornography shall also be marked.
4.6. The User may place links to other websites (third party websites), as well as articles, photos, illustrations, graphics, music, sounds, videos, information and other Content belonging to or originating from third parties(third party Content). The Alaguide Right Holder shall not be liable for any information posted on third party websites to which you received access through third party Content. The User who posted the Content shall be liable for infringing the rights to posted materials.
5. Limitations
5.1. Except for use to the extent and by the means expressly provided by this License or laws of Kazakhstan in effect when the License was granted, the User may not engage and/or permit engagement in the following actions: translation, revision, other processing or other use of the Program not expressly provided by this License.
5.2. The User may not reproduce or distribute the Program for commercial purposes (for payment), including as part of a software package, without the Right Holder’s written consent.
5.3. The User shall not be permitted to modify, decompile, disassemble, decrypt or perform other actions with the Program’s object code aimed at breaching the security of the Program and obtaining information on implementing the algorithms used in the Program, or to develop software derivatives using the Program without the Right Holder’s written consent.
5.4. Any copying, reproduction and posting of Alaguide content without the Right Holder’s written consent is prohibited.
6. Liability under the License
6.1. The Program is provided to the User for use «asis«: The Right Holder makes no guarantee of error-free and uninterrupted operation of the Program or the Program’s compatibility with the User’sspecific objectives, and makes no other guarantees not expressly stated in this License.
6.2. To the fullest extent permitted by applicable law, the Right Holder, along with its partners, shall not be liable for any direct or indirect consequences of using or inability to use the Program and/or damage caused to the User and/or third parties due to any use of or failure to use the Program, including as a result of possible errors or malfunctions of the Program.
6.3. Use of the Program by the User in a manner not specified in this License Agreement, or on cancellation of such an agreement or otherwise beyond the rights granted to the User under this Agreement entails liability for infringement of exclusive right to intellectual property or to means of individualization established by applicable law.
